Examples of Regulation

There are numerous ordinances as well as state and federal laws and regulations and programs that may directly or indirectly affect forest management activities and practices on nonindustrial private forestlands. A local noise ordinance, for example, might prohibit noise over a certain decibel level within a city's limits, which in turn could prohibit the operation of cutting or skidding machinery in or around that area. Harvesting timber on a tract of forestland, where the removal of trees results in the violation of a municipality's visual buffer or landscaping ordinance, is another example of a possible regulatory issue that might be encountered while conducting forestry practices; even if they are included in an approved forest management plan.

It is critically important that forest landowners, consulting foresters, and others involved with forest management practices be familiar with any laws and regulations that may apply to lands subject to these practices. Also, these laws and regulations may not only apply to lands directly subject to forest management practices but they may also pertain to adjoining properties, roads, water bodies, and others as well that may be affected by these practices.

Violations of these local, state, and federal laws and regulations can and does oftentimes result in fines, legal costs, and other expenses paid by the forest landowner.
